Appellate courts are significantly different from trial courts. Appellate courts do not hear new evidence; they decide cases based on the record of events that occurred in the trial court.
Appellate courts apply certain standards of review to rulings made by a trial court. Because of the standards of review, issues that were important at trial sometimes become less important on appeal. Conversely, differences among standards of review can make a trial issue more important on appeal.
Appellate Lawyers
The professional skills of a lawyer who handles appeals differ from the skills of a trial lawyer. An appellate lawyer does not examine witnesses. An appellate lawyer reviews the record and prepares a comprehensive legal brief. The brief presents the story of the case to the appellate court, and crafts legal arguments to try to preserve or reverse the outcome in the trial court (depending on the point of view represented).
Thorough review of the appellate record, and preparation of a persuasive appellate brief, are best accomplished through work performed in continuous or prolonged blocks of time. Often, the type of work performed by trial lawyers does not allow trial lawyers to set aside such large blocks of time.
